Another unique aspect of representing the minor child in a personal injury action is who actually owns the claim. Well, there are two separate and distinct claims that arise when a minor child is injured as a result of someone else’s negligence. The parents and/or guardian actually own the claim for the medical bills the child incurs. That’s because the parents are the ones who are actually responsible for paying the minor child’s medical expenses as they come due. The minor child, on the other hand, actually owns the injury claim or the pain and suffering aspect of the personal injury matter. So they are two separate and distinct cases, or claims rather, that get brought together at the same time when a minor child is injured.
