We had the privilege of representing a small business client who suffered a devastating loss of inventory in a fire. This was a hard fought case where the Defendant corporation was proven to have engaged in unsafe business practices that resulted in the destruction of our client’s inventory by fire. Specifically, the Defendant was a foam recycling facility that dealt primarily with used carpet padding. Although used carpet padding is very flammable, the Defendant corporation allowed customers to drop the padding off after hours and stack the padding up against the building they shared with our client. One night, padding that was stacked against the building caught on fire and made its way into our client’s business, destroying all of its inventory. Even though the Defendant’s employees vehemently denied allowing customers to drop off carpet padding after hours, we were able to secure eye witness testimony proving otherwise. The Defendant’s insurance company had offered $80,000.00 to settle the case prior to trial. They increased their offer to $200,000.00 after closing arguments. The jury awarded the precise amount we asked for.
