Punitive Damages Awarded in Dog Attack Case Due to Prior Incident
Tidwell Strimban obtained a $125,000.00 settlement for our client after a dog bit her while she was jogging on a public road. As our client was jogging, a dog broke loose from a private residence and attacked our client, biting her on the leg. The bite became infected and led to significant medical treatment.
In Georgia, you must show that the attacking dog had a propensity for violent behavior. Through our investigation, we were able to obtain reports showing the dog had bitten someone else before attacking our client.
Using this information, we not only showed that the dog owners knew they had a violent dog, but also failed to act responsibly to prevent another dog attack from occurring. This enabled us to argue for punitive damages as well as compensatory damages.
