Our client was an 8-year-old-boy who attended a fireworks show on the 4th of July. The property owner charged each car to park on the property to view the show. Unfortunately, the property contained a large baseball field with an iron gate controlling access to the portion of the baseball field known as the bullpen. The large iron gate had a lock laying up against it, but it was not fastened. A large group of children were playing on the 2 foot wall that runs the length of the bullpen. The children were jumping off of the wall onto the ground. Our client was standing on the wall, holding onto what he thought was a pole but was actually the hinge of the large iron gate. Another child closed the gate and cut the end of our client’s finger off. The settlement was structured in such a way that the child will receive nearly $1,000,000.00 in payments that will begin after her turns 18.
