We had the privilege of representing a lady who was a back seat passenger in a car that was struck head on by a car that negligently crossed the center line of the road. The at-fault driver claimed that she hydroplaned when she drove over a wet spot on the road, causing the wreck. The at-fault driver stuck to her story when we took her sworn testimony at her deposition; going so far as saying that her cell phone was in her purse the entire time. However, we subpoenaed copies of the at-fault driver’s cell phone records which revealed she had made and/or received more than 20 text messages in the minutes leading up to the wreck. Our client suffered broken ribs and remained in the hospital for several days following the wreck. Fortunately, our client was able to make a full recovery from her injuries.
