Our client was a 3 year old child who was left unattended on the playground at her daycare. Initially, the daycare claimed that the child injured herself while being disobedient. The owner and teacher of the daycare claimed that the child was running on the playground equipment after being told to stop. Our client’s mother did not believe the story and pressed the owner for details. At this time, our client’s mother discovered that there were surveillance cameras on the playground and she demanded to see them. We were able to send a notice to preserve evidence to the daycare, forcing the preservation of the video. Upon watching the video, we learned that the child had been left unattended on the playground equipment. The child climbed to the top of the equipment and fell off, suffering a broken arm and a dislocated elbow. Fortunately, our client experienced a full recovery.
