Our client was a passenger in a boat traveling on the inter-coastal waterway in Alabama. A very large yacht sped by in the opposite direction causing a significant wake that threw our client out of her seat and fractured a vertebra in her back. She incurred well over $100,000.00 in medical bills as she required immediate surgery to address her injuries. Unfortunately, there was only $100,000.00 in available insurance and Medicare demanded to be paid back for the medical expenses. After wrangling with the insurance company over whether or not a violent “wake” was sufficient “contact” with our client’s boat to trigger coverage, the insurance company eventually agreed with our position and paid the $100,000.00 of available insurance. We were then able to convince Medicare to accept a reduction of its claim for reimbursement, which resulted with the client receiving in excess of $40,000.00 paid directly to her.
