You have just been involved in a car wreck, and not more than a day or so later, you get a phone call from the at-fault driver’s insurance company, and they’re calling and asking for you to do a recorded statement. You are under no obligation to do this. In fact, you should not do this at that point. All that this insurance company is trying to do is gather information that will hurt your case and help them. You can speak with a representative of that insurance company, sometimes about property damage, things like that, but under no circumstances do you need to do a recorded statement. This will be a statement that they will hold on to and that they will later try to use to hurt your case.
